About This Agreement
This Business Associate Agreement is entered into between AppleSoft Medical Solutions ("Business Associate") and your organization ("Covered Entity"). It satisfies the BAA contract requirements under 45 CFR 164.504(e).
What it covers
- Permitted uses and disclosures of PHI by AppleSoft Medical Solutions in providing wound assessment services
- Safeguards, breach reporting, and subcontractor obligations
- Individual access, amendment, and accounting of disclosures
- Term, termination, and return/destruction of PHI
Key obligations of the Business Associate (AppleSoft Medical Solutions)
- Implement HIPAA Security Rule safeguards for all ePHI
- Report any unauthorized PHI use or Security Incident within 10 business days
- Report any Breach of Unsecured PHI within 60 calendar days per 45 CFR 164.410
- Require subcontractors to meet the same standards in writing
- Return or destroy all PHI upon termination
Key obligations of the Covered Entity (your organization)
- Notify AppleSoft Medical Solutions of any limitations in your Notice of Privacy Practices that affect PHI use
- Not instruct AppleSoft Medical Solutions to use or disclose PHI in a manner that would violate HIPAA
Governing law: State of Texas and applicable federal law including HIPAA.
